Start with eligibility, not the headline amount
Ontario's first-time homebuyer refund has conditions about age, prior ownership, occupancy, and spouses. A buyer should not assume eligibility from the phrase ‘first home’ alone. Tell your lawyer if you or your spouse has ever owned an eligible home or an interest in one, including outside Ontario. The official rules also address how the refund is allocated when only some purchasers qualify.
Give accurate information before closing
Provide every purchaser's full legal name, status, ownership history, and intended use of the property. Tell the lawyer if a partner, parent, or other person will be on title or provide funds. An inaccurate declaration can create a tax problem. Ask for a written closing estimate that separately identifies purchase funds, land transfer tax, possible refund, legal expenses, adjustments, and lender costs.
Know where the claim fits
A qualifying refund may be claimed at registration or by application after the transfer, subject to the applicable deadline and supporting documentation. Ask your lawyer which process applies to your purchase. Do not treat a potential refund as cash available before the legal work has established eligibility.
Ottawa versus Toronto
An Ottawa purchase is subject to Ontario's rules. Toronto has a separate municipal land transfer tax regime for property in that city; it is not an extra Ottawa tax. Other taxes or charges may depend on the particular transaction, so ask for a property-specific estimate.
Questions to bring to your lawyer
Have you or your spouse previously owned a qualifying home anywhere? Who will be registered on title? Will you occupy the home as your principal residence within the required period? Are any purchasers non-residents? Keep your agreement, identification, and ownership-history information together so the firm can assess the applicable declarations and closing funds.
