Closing Costs When Buying a Home in Ottawa

The common expenses and adjustments to budget for in addition to your down payment.

The purchase price and down payment are only part of the amount needed to complete an Ottawa home purchase. Buyers should also budget for taxes, legal work, title protection, registration expenses, adjustments, and other transaction-specific charges.

The final amount cannot be calculated accurately from the listing price alone. It depends on the property, agreement, financing, ownership structure, closing date, and information received from the seller, municipality, lender, and other parties.

Ask for an estimate early—but keep a reserve.

An early estimate helps with budgeting, while the final trust statement and amount required for closing are prepared after the lawyer receives the necessary documents, adjustments, and lender instructions.

Ontario Land Transfer Tax

Ontario generally charges land transfer tax when an interest in land is acquired. The amount is calculated using provincial rates and the value of the consideration for the transfer. Unlike Toronto, Ottawa does not currently impose a separate municipal land transfer tax.

Eligible first-time homebuyers may qualify for an Ontario refund of some or all of the provincial tax, subject to the program requirements. Eligibility should be confirmed rather than assumed, especially where more than one buyer will be registered on title or a buyer has previously owned a home.

Legal Fees and Disbursements

A lawyer’s account may include professional fees plus disbursements paid or incurred to complete the transaction. Depending on the file, disbursements may relate to searches, registrations, title insurance, couriers, software platforms, bank charges, document production, or other required services.

Ask whether an estimate includes HST, title insurance, registration charges, lender-related work, and possible additional fees for unusual circumstances. A private mortgage, condominium issue, multiple mortgages, title problem, rush closing, or change to the agreement may affect the work required.

Title Insurance

Title insurance is commonly arranged in Ontario residential transactions. FSRA describes it as insurance that protects property owners and lenders against specified losses related to title or ownership. Coverage depends on the policy and exclusions.

Title insurance is not a substitute for every search, inspection, survey, or piece of legal advice. Your lawyer can explain the proposed policy, what it covers, and whether other steps are appropriate for the property.

Registration and Search Costs

The transfer and any mortgage must generally be registered through Ontario’s electronic land-registration system. The transaction may also require title, execution, tax, utility, condominium, or other searches depending on the property and closing arrangements.

These expenses are usually included among the legal disbursements or reflected separately on the lawyer’s account.

Property Tax Adjustments

Property taxes are adjusted on closing so that the buyer and seller bear the appropriate share based on the closing date and amounts paid. If the seller has prepaid taxes, the buyer may reimburse the seller for the applicable period. If taxes remain unpaid, the adjustment may operate differently.

The Statement of Adjustments sets out these calculations. After closing, Ottawa buyers should also ensure that ownership and contact information is current with the City’s Revenue Services.

Condominium and Other Adjustments

For a condominium purchase, common expenses may be adjusted. Other possible adjustments depend on the agreement and property and could include prepaid utilities, fuel, rent, deposits, or other items.

New construction purchases can involve additional adjustments, levies, HST treatment, warranty enrolment, development-related charges, and builder-specific costs. Buyers should review the agreement and amendments carefully because these charges can be materially different from a typical resale purchase.

Mortgage and Lender-Related Costs

A lender may require an appraisal, insurance, mortgage-default insurance where applicable, title insurance, identification, proof of funds, or other conditions. Some costs are paid outside the lawyer’s office; others may appear in the mortgage advance or closing statement.

The mortgage amount approved is not necessarily the amount the lawyer receives. Lender deductions, interest adjustments, existing obligations, or fees can affect the net funds available for closing.

Home Insurance, Inspections, and Moving Expenses

Buyers should separately budget for home insurance, inspections, moving, utility setup, repairs, furnishings, and immediate maintenance. A lender commonly requires proof of property insurance before funds are advanced.

These are not all legal closing costs, but they affect the cash a buyer needs during the same period.

How Much Money Must Be Delivered to the Lawyer?

The amount normally reflects the balance of the purchase price after deposits and mortgage proceeds, plus land transfer tax, legal fees, disbursements, and adjustments. It may also reflect lender deductions or other amounts required by the agreement.

Follow the law firm’s verified trust instructions and deadline. Never rely on wiring instructions sent only by an unexpected email or message. Confirm payment directions using a trusted telephone number before transferring funds.
