Named Estate Trustee in Ontario? First Steps to Consider

Early organization for a person named as an estate trustee, including records and probate questions.

Being named as estate trustee can involve substantial administrative responsibility. The first useful step is to understand the will, the assets, the debts, and whether an estate certificate will be needed for a particular institution or asset. Avoid distributing property before the obligations are understood.

Locate the will and identify your role

Find the original will and any codicils and confirm who is named as estate trustee. An older copy may not reflect the final instructions. If more than one trustee is named, clarify how they will work together. Keep a secure record of what was found and when.

Make an inventory before distributions

List bank and investment accounts, real property, vehicles, personal property, insurance, debts, recurring expenses, and potentially relevant tax records. Some assets may pass outside the estate, while others may require estate administration; this depends on ownership and beneficiary designations. Do not promise a beneficiary a date or amount before the full picture is known.

Determine whether probate is needed

An estate certificate is a court document confirming authority where the relevant application succeeds. A bank, land registry issue, or other institution may require it in some circumstances. Keep careful accounts

Record money received, bills paid, supporting receipts, and communications with beneficiaries and institutions. Estate trustees may need to address debts and taxes before distribution. If there are disputes, uncertain assets, a business, or property outside Ontario, obtain tailored legal and tax advice promptly.
