Child Support and Income Disclosure in Ontario

Why accurate income information and ongoing updates matter in child support discussions.

Child support is a child's right, and the relevant amount depends on the applicable guidelines and facts. A discussion based on incomplete income information can create avoidable disagreement later. The right documents make legal advice and negotiation more useful.

Identify the applicable framework

Federal or provincial child support guidelines may apply depending on the family's circumstances. Table amounts, parenting arrangements, special expenses, and other factors may matter. Do not infer a final amount from a quick online calculation without checking the correct rules and current information.

Gather reliable income records

Justice Canada explains that initial disclosure under the Federal Child Support Guidelines can require complete income information for the previous three tax years. Tax returns, notices of assessment, recent earnings information, and records for self-employment or a corporation may be relevant. The documents needed depend on the claim and applicable rules.

When both parents' information matters

In shared or split parenting arrangements, special or extraordinary expenses, and certain other circumstances, both parents' income may need to be considered. Ask how an expense is defined, what reimbursement or benefit applies, and which supporting receipts should be kept. Avoid treating an estimate of take-home pay as the same as guideline income.

Update when circumstances change

Support orders and agreements may require continuing disclosure. Changes in income, parenting arrangements, or a child's needs can warrant review. Keep dated records and seek advice on the proper way to change an existing obligation; an informal conversation may not modify an order.

Bring existing orders or agreements, three years of available tax records, current pay information, a summary of parenting time, and records of claimed child expenses. Identify missing records candidly so the lawyer can explain the next disclosure step.
